Rule 11: Appointment, Probation, Promotion, Demotion, and Transfer

SECTION 1. GENERAL: Vacancies may be filled by permanent, probationary, provisional, or temporary appointments, as well as by transfer, promotion, or demotion. SECTION 2. APPOINTMENT AND NOTIFICATION OF APPLICANTS: The appointing authority will interview all candidates certified to the requesting department before making an appointment. All candidates on an eligible list in the top seven (7) ranks or established bands are eligible for selection. Attached is the Probation Department Transfer Policy. The parties agree that application and interpretation of this policy is subject to the negotiated grievance process. The parties further agree that the Department retains the right to amend, suspend or terminate this policy in accordance with the provisions set forth in the attached policy. DSA 33.7 Involuntary Transfers for the Alleged Purpose of Punishment

Any sworn peace officer in the Sheriff’s Department who believes they have been subjected to a transfer for the purpose of punishment may appeal said transfer through the chain of command to the Sheriff (or, in cases where the Sheriff has been personally involved, to the Human Resources Director or designee).
