DSA 10. Application of Differential

In DSA-Sworn Safety

For employees who have been:

  • regularly working a shift described in Section 9, and/or
  • assigned to and regularly working a special job assignment enumerated in Exhibit B of this Memorandum, and/or
  • eligible for and receiving Career Incentive Allowance for Law Enforcement Officers as provided in Section 14, for 30 or more calendar days immediately preceding a paid holiday, the commencement of a vacation, paid sick leave period, or comp time off, as the case may be,
  • the applicable differential shall be included in such employee’s holiday pay, vacation pay, paid sick leave or paid comp time. The vacation, sick leave, holiday and comp time off pay of an employee on a rotating shift shall include the differential such employee would have received had they been working during such period. Shift differential does not apply when employees are assigned modified duty, unless their modified duty assignment requires them to work between 6:00 p.m. and 6:00 a.m.
